Terms of Service

1. Nature of Service / सेवा की प्रकृति

Samaj Vivah is a free, community-driven matrimony platform operated as a social service (samaj seva). It is not a licensed marriage bureau, not a commercial matchmaking agency, and does not charge fees for any core service.

The platform acts solely as an intermediary under the Information Technology Act, 2000 (Section 79), providing a digital space for community members to connect. We do not arrange marriages, guarantee matches, or take responsibility for the outcome of any introductions.

Samaj Vivah एक निःशुल्क, समुदाय-संचालित विवाह मंच है। यह एक लाइसेंस प्राप्त विवाह ब्यूरो नहीं है। हम केवल IT अधिनियम 2000 की धारा 79 के तहत एक मध्यस्थ के रूप में कार्य करते हैं।

2. Eligibility / पात्रता

• You must be at least 18 years old (female) or 21 years old (male) as per the Prohibition of Child Marriage Act, 2006.
• You must be legally eligible to marry under applicable Indian law at the time of registration.
• You must provide truthful and accurate information. Creating a profile with false information is prohibited.
• One person may maintain only one active profile at a time.

3. User Responsibilities / उपयोगकर्ता की जिम्मेदारियाँ

By using this platform, you agree to:

• Provide accurate, current, and complete information in your profile
• Not post false, misleading, obscene, or deceptive content
• Not harass, threaten, abuse, or impersonate any person
• Not solicit money, gifts, or financial assistance from other users
• Not demand or discuss dowry in any form
• Not share another user’s personal details (phone number, address, photos) with third parties without their explicit consent
• Not use the platform for commercial advertising or solicitation
• Conduct your own independent verification of any person you intend to meet or marry

4. Platform as Intermediary / मंच की मध्यस्थ भूमिका

Samaj Vivah operates as a technology intermediary under Section 79 of the Information Technology Act, 2000. This means:

• We provide a platform; we do not create, initiate, or select the recipients of any user content
• We are not liable for any third-party content posted by users
• We act promptly upon receiving valid complaints about unlawful content
• We co-operate with law enforcement as required by applicable law

5. No Verification / कोई सत्यापन नहीं

6. Limitation of Liability / दायित्व की सीमा

To the maximum extent permitted by applicable law, Samaj Vivah and its operators shall not be liable for:

• Any loss or harm arising from interactions between users
• Matrimonial fraud, misrepresentation, or deception by any user
• Any decision made by users based on profile information
• Temporary service interruptions or data loss due to technical issues
• Any consequential, indirect, or incidental damages

The platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

7. Content Moderation / सामग्री मॉडरेशन

We reserve the right to remove any content or suspend/terminate any account that:

• Violates these Terms
• Is reported multiple times by other users
• Is obscene, fraudulent, or unlawful under Indian law
• Is used to deceive or harm other community members

8. Free Service & Future Advertising / निःशुल्क सेवा और भविष्य में विज्ञापन

Samaj Vivah’s core matrimony features are currently free of charge. We may introduce advertising on the platform in the future to cover operational costs. Any advertising will be:

• Clearly labelled as “Advertisement” or “Sponsored”
• Non-intrusive and community-appropriate
• Not based on selling user personal data

We may also introduce optional premium features in the future. Core matching and communication features will remain free.

10. Intellectual Property / बौद्धिक संपदा

The Samaj Vivah name, logo, and platform design are the property of the platform operators. You may not reproduce, copy, or distribute any part of the platform without written permission.

Content you post (photos, biodata text) remains yours. You grant us a limited licence to display it to other logged-in community members as part of the service.

11. Governing Law & Dispute Resolution / शासित कानून

These Terms are governed by the laws of India, including:

• Information Technology Act, 2000 and its amendments
• Digital Personal Data Protection Act, 2023
• Consumer Protection Act, 2019 (to the extent applicable)
• Indian Contract Act, 1872

Any disputes shall be subject to the exclusive jurisdiction of the competent courts in India. We encourage users to first raise concerns with our Grievance Officer before initiating legal proceedings.

12. Changes to Terms / शर्तों में बदलाव

We may update these Terms from time to time. Significant changes will be notified via in-app notification. Continued use of the platform after any change constitutes acceptance of the new Terms.
